Who can apply for a K-1 visa?

Only U.S. citizens can file a petition for a foreign fiancé(e) to come to the United States on a K-1 visa. Lawful permanent residents (green card holders) are not eligible to file this type of petition. 

The process begins with filing Form I-129F with U.S. Citizenship and Immigration Services (USCIS). The petition must prove that both partners are legally free to marry, have met in person at least once within the last two years (unless granted a cultural or hardship waiver), and intend to marry within 90 days of the fiancé(e)’s arrival. 

Once USCIS approves the petition, it is forwarded to the National Visa Center (NVC) and then to the appropriate U.S. consulate abroad for visa processing.

How long does the K-1 process take?

The total processing time for a K-1 visa varies depending on where you live and which consulate is handling the case. On average, it takes about 8 to 12 months from the date USCIS receives your petition to the date the visa is issued. 

Timelines depend on USCIS workload, background checks, the speed of the NVC’s document transfer, and the interview appointment availability at the U.S. embassy or consulate. 

After the visa is issued, your fiancé(e) can travel to the United States, marry you within 90 days, and then apply for Adjustment of Status to obtain a green card.

Do we have to marry in the U.S.?

Yes. A K-1 visa allows your fiancé(e) to enter the United States solely for the purpose of marriage to you, the U.S. citizen petitioner. The marriage must take place within 90 days of entry. 

The visa cannot be used for travel or marriage abroad, and it cannot be converted to any other visa category if the wedding does not occur. 

Once the marriage takes place, the foreign spouse may remain in the U.S. and apply for a green card through Adjustment of Status.

What happens if we don’t marry within 90 days?

If the marriage does not occur within 90 days of your fiancé(e)’s arrival, the K-1 visa automatically expires. 

Your fiancé(e) must then leave the United States or risk falling out of legal status, which could lead to removal proceedings or affect future immigration eligibility. In rare cases where unexpected circumstances prevent timely marriage, legal options may exist, but they are limited. 

It’s critical to address any delays immediately to preserve your fiancé(e)’s lawful status and avoid complications with USCIS or the Department of Homeland Security.

Can my fiancé(e) work after arriving in the U.S.?

Yes, but work authorization is not automatic. Your fiancé(e) must apply for a work permit (Employment Authorization Document, or EAD) after entering the United States.

The first work permit can be requested immediately upon arrival using Form I-765, though it is typically valid only for the 90-day K-1 period. After marriage and while waiting for green card approval, your spouse can apply for a new, extended EAD as part of the Adjustment of Status package. 

Once the green card is approved, no separate work authorization is required. Proper timing of these applications ensures there are no gaps in work eligibility.
