Did you know that with the right job offer in the U.S., an employer may be able to sponsor an application for you to become a legal permanent resident?
There are several categories of employment based immigrant visas, some requiring advanced degrees or exception ability in your field, but not all. Each category has specific eligibility criteria and processing times.
EB-1: Priority Workers
The EB-1 visa is ideal for individuals with extraordinary achievements or executive leadership experience. This high-priority category offers faster processing and does not require PERM labor certification.
EB-1 subcategories include:
EB-1A (Extraordinary Ability): For those with sustained national or international recognition in science, arts, education, business, or athletics. No job offer needed.
EB-1B (Outstanding Professors and Researchers): Requires at least 3 years of experience and a permanent job offer from a U.S. employer.
EB-1C (Multinational Executives and Managers): For corporate leaders transferring to the U.S. from an affiliated company abroad.

EB-2: Advanced Degree and Exceptional Ability
The EB-2 visa is available to professionals with advanced degrees or individuals with exceptional ability in their field.
There are two primary paths:
EB-2 with PERM Labor Certification: Requires a U.S. employer to sponsor the applicant for a job requiring an advanced degree (master’s or higher, or equivalent experience).
EB-2 National Interest Waiver (NIW): Allows professionals to self-petition if their work benefits the U.S. as a whole. No employer or labor certification required.

EB-3: Skilled, Professional, and Other Workers
This category includes:
Skilled Workers: Jobs requiring at least two years of experience or training.
Professionals: Jobs that require a U.S. bachelor’s degree or equivalent.
Other Workers: Unskilled positions requiring less than two years of training or experience.
All EB-3 petitions require a job offer and PERM labor certification.
